This agreement is with Fervo LLC ("Fervo", "we", "us"). These Terms govern your use of fervopass.com and the Fervo ticketing platform, including the Fervo organizer app (the "Services"). By using the Services, buying a ticket through them, or organizing an event on them, you agree to these Terms.
1. Who we are
Fervo LLC is an event ticketing platform. We provide tools for event organizers to sell tickets, manage guest lists, and check in attendees at the door. Throughout these Terms, "organizer" (sometimes called a "host") means a person or business that creates events and sells tickets using Fervo; "attendee" or "buyer" means someone who buys or holds a ticket to an organizer's event.
2. Our role
Fervo provides ticketing software and payment infrastructure. For events sold through Fervo's own checkout, payments are processed by Stripe, Inc. ("Stripe") and settle into the organizer's own Stripe account under Stripe Connect. Fervo is not the merchant of record for tickets sold by organizers, is not the venue, and is not the presenter of the event. The organizer is responsible for their event, their event's content, and their relationship with their attendees.
Fervo may also consolidate order information from other ticketing providers (such as Eventbrite or Universe) at an organizer's direction. When we display orders sourced from another provider, that provider's own terms also apply between you and that provider for the underlying purchase. Those providers are solely responsible for the sales they process.
3. Accounts
Buyer accounts use passwordless sign-in: you give us your email address and we send you a one-time login code. You are responsible for access to your email inbox and for keeping your login codes private. Organizer accounts may be provisioned by Fervo or by the organizer's team, and organizers are responsible for who on their staff can scan tickets or view sales data.
4. Tickets and orders
- A completed purchase produces an order with a confirmation number and one QR-code ticket per attendee, delivered to the buyer's email address.
- Tickets are scanned at the door. A scanned ticket is marked as used. Do not buy tickets from third parties or resellers; only tickets delivered by Fervo (or the original provider) can be validated.
- Orders may be cancelled or refunded as described in our Refund Policy, which is part of these Terms.
- You may not resell tickets through unauthorized channels, use the Services unlawfully, or attempt to circumvent ticket limits or security measures.
5. Payments
Purchases made through Fervo's checkout are charged at the time of sale. Prices, fees, and the party charging you are shown at checkout before you pay. Card data is handled entirely by Stripe; Fervo does not store full card numbers. Disputes and chargebacks are processed by Stripe and the card networks, and the outcome of a chargeback is determined by those parties.
6. Refunds
Refunds follow the refund policy of the organizer of the event, which every buyer must accept at checkout and which is published at fervopass.com/refunds. See our Refund Policy page for how refunds are requested and processed.
7. Event changes and cancellations
If an organizer cancels or materially changes an event, the organizer is responsible for communicating that to attendees and for issuing any refunds owed. Fervo will reasonably assist organizers in processing refunds through the payment rails used for the original sale.
8. Acceptable use
You agree not to misuse the Services. That includes scraping, interfering with door scanning or inventory systems, creating fraudulent orders, uploading malicious code, and using the Services to promote unlawful activity. We may suspend accounts that violate these Terms or put attendees, organizers, or payment partners at risk.
9. Intellectual property
The Fervo name, logo, and software are owned by Fervo LLC. Organizers own their event content and branding. Attendees receive a personal, non-transferable right to attend the event their ticket names, subject to the venue's rules.
10. Disclaimers and limits
The Services are provided "as is." To the fullest extent permitted by law, Fervo disclaims implied warranties and is not liable for indirect or consequential damages. Nothing in these Terms limits liability that cannot be limited by law. Because Fervo does not set event content and does not hold organizer funds, claims about an event itself should be raised with its organizer.
11. Changes and governing law
We may update these Terms; material changes will be posted here with a new effective date. Continued use after posting constitutes acceptance. These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law rules.
